Agreement to terms
By accessing or using SwingTradeScanner ("the Service"), operated at swingtradescanner.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Not investment advice
SwingTradeScanner is a market analysis tool for research and educational purposes only. The scans, ratings, rankings, and data presented by the Service describe market conditions and technical patterns. They are not investment advice, recommendations, or offers to buy or sell any security.
You are solely responsible for your own investment decisions. Any trades you make based on information from this Service are made at your own risk. Past performance of any scan or rating does not guarantee future results. You should consult a qualified financial advisor before making investment decisions.
No warranty on data accuracy
Market data displayed by the Service is sourced from third-party providers and may be delayed, incomplete, or inaccurate. Corporate actions (splits, dividends, mergers) are handled heuristically and may not be reflected accurately in all cases. We make no warranty, express or implied, regarding the accuracy, completeness, or timeliness of any data or analysis.
Account registration
To use the Service, you must create an account using a valid email address or sign in through a supported social login provider (Google or Facebook). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate information during registration. One account per person. You may not share your account with others or create multiple accounts.
Subscription and billing
Some features of the Service require a paid subscription. Subscription plans, pricing, and billing terms are displayed at the time of purchase. All payments are processed by Stripe.
- Subscriptions renew automatically at the end of each billing period unless canceled before the renewal date.
- You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
- Refunds are handled on a case-by-case basis. Contact us if you believe you are entitled to a refund.
Acceptable use
You agree not to:
- Scrape, crawl, or programmatically extract data from the Service
- Resell, redistribute, or republish the rankings, ratings, or analysis provided by the Service
- Attempt to gain unauthorized access to other accounts or our systems
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service or its infrastructure
- Share your account credentials with third parties
Intellectual property
The Service, including its design, code, scanning algorithms, and original content, is owned by SwingTradeScanner. Market data is provided by third parties and subject to their respective terms. You may use the Service for your personal, non-commercial research. You may not copy, modify, or distribute the Service or its output for commercial purposes.
Third-party services
The Service integrates with third-party services including Stripe (payments), Google and Facebook (authentication), and market data providers. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.
Limitation of liability
To the maximum extent permitted by law, SwingTradeScanner and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, data loss, or other intangible losses, resulting from your use of or inability to use the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless SwingTradeScanner and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Termination
We may suspend or terminate your account at any time if you violate these Terms. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and the investment advice disclaimer) will survive.
Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "last updated" date at the top. If we make material changes, we will notify you by email or through a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the state where SwingTradeScanner is operated.
